Purpose and Background
The 2013 update of E 1527 Phase I ESA Process, approaching its 20th year in commercial use, includes modifications to Historical Recognized Environmental Condition (HREC) and Recognized Environmental Condition (REC) definitions, adds a new term, Controlled Recognized Environmental Condition (CREC), and clarifies the Regulatory Agency file reviews process. E 1903, the Phase II ESA process, has not received the commercial acceptance of E 1527. However, the 2013 update of E 1903 provides more flexibility for relating legal considerations when undertaking a Phase II assessment, a standard most often used in Brownfield grants administered by the EPA. This webinar will discuss these changes and address the information required to determine the likelihood of hazardous substance release, maintain CERCLA liability protections, evaluate business environmental risk in a transaction setting, and the obligation to disclose liabilities in financial statements and securities disclosures.
